Coverage Advice and Monitoring

Coverage Advice

The insurance defense lawyers at Chasnoff Valkenaar Pepping & Stribling, LLP are committed to protecting the interests of insurers facing complex coverage questions.

Our attorneys have extensive experience advising on coverage issues arising out of a variety of insurance policies including, directors and officers, management liability, private equity liability, pollution legal liability, professional indemnity, errors and omissions, CGL, property insurance, title insurance, and excess insurance. We have counseled insurers on coverage questions ranging from the scope of an insuring provision to the applicability of policy exclusions and endorsements. We also routinely advise insurers on many of the unique coverage issues that arise under Texas law, including navigating the duty to defend and indemnify, analyzing exhaustion issues, and responding to Stowers demands.

When our attorneys evaluate a coverage issue, they draw upon their wealth of experience litigating coverage cases. We understand that coverage litigation can be costly and detrimental to an insurer’s business, and we strive to ensure that the advice we provide our insurance clients helps mitigate their risks.

In addition to providing coverage advice, our attorneys have significant experience monitoring claims and trials on behalf of insurers. We routinely provide case evaluations and settlement recommendations to insurers on a wide range of cases, and we frequently participate in mock trials to help our clients and their insureds prepare for trial and understand their strengths and vulnerabilities. We regularly work with defense counsel to develop strategies to minimize an insured’s exposure, while preserving potential arguments for appeal. When we monitor a case, our goal is to keep potentially costly claims from negatively impacting our client’s business.
